I have no habitation licence on my property in Spain how do I get one?

I have had the property for 2 years and still have no habitation licence I have been told that the plans are at the town hall, is this right. the development is different to the plans, how do I contact the town hall in Benalmadena

Hi, getting a habitation license might be more simple or difficult depending on the year the building was constructed, new or old building, first occupant or latter, urbanized vs rural areas etc.

A solicitor might help, however unless you believe there is some mayor problem with your specific property a gestoría can manage it and for a cheper price do all the bureaucratic requirements for you.

Yes, the documents and plans you need should be in the Town hall – Ayuntamiento or in the Registro de la propiedad.
You must get a licencia de Primera Habitación (if you are the first occupant). Double clicking below takes you to the oficial site of Benalmadenas Townhall. You need patience with their server:

AYUNTAMIENTO DE BENALMADENA –
Avda. Juan Luis Peralta, 20 -

Spain
Phone: (34) 952579800
Fax: (34) 952579893
e-mail: alcaldia@benalmadena.com

Almost all professionals or private owners get their first ocupation licence through a gestoría since it the easiest and cheapest way to do so. They will ask you for some basic data, names, ownership, ID, etc. And then they will do all the paperwork for you. Doubleclicking link below will take you to a page with all the gestorías of Benalmadena. You can chose a specific gestoria and press telephone, +info, email, contact etc and you can also search in that page for more resources in Benalmadena, Málaga:

Hope it helps

If you have no habitation licence then you cannot have electricity or water connected and on your escritura you should have it down as habitation otherwise its an illegal build!!!
ring your builder he should sort this out if not your lawyer its very important you sort this quickly
